Terms of Service
Last updated October 25, 2026
These Terms of Service ("Terms") govern your use of DiscoverVirals, including the website at discovervirals.com and any related features (the "Service"). "DiscoverVirals", "we", "us" and "our" refer to the operator of the Service. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you confirm that you meet these requirements.
2. Accounts and access
Access to the Service is provided through your account with MegaBerry, a separate service with its own terms and privacy policy. The Service is included with eligible MegaBerry plans (currently MegaBerry Pro and Max). If your MegaBerry plan ends, lapses or changes to a plan that does not include the Service, your access may end. A limited number of accounts may sign in with an email address and password.
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at [email protected] if you believe your account has been used without your permission.
3. Plans and billing
We do not charge you directly. Any payment for a plan that includes the Service is handled by MegaBerry under MegaBerry's terms. We may change which plans include access to the Service.
4. Third-party content
The Service helps you find and organize content that has been publicly posted on third-party platforms. That content belongs to its creators and rights holders, not to DiscoverVirals and not to you. DiscoverVirals is not affiliated with, sponsored by or endorsed by those platforms.
You are solely responsible for how you use any content you find, save or download through the Service. You must have the necessary rights, permission or another valid legal basis before you copy, republish, adapt or otherwise reuse anyone else's content, and you must follow the terms of the platform where it was posted. Downloads are provided for personal research and reference.
5. Copyright and removal requests
If you believe content available through the Service infringes your copyright, or you are a creator who would like your public content or profile removed, email [email protected] with: a description of the work or content, where it appears in the Service, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement that the information in your request is accurate and that you are the rights holder or authorized to act for them. We may remove content and may suspend accounts that repeatedly infringe.
6. Acceptable use
You agree not to:
- copy, scrape, crawl or bulk-export the Service or its data, except through features we provide;
- resell, sublicense, rent or share your access with anyone else;
- reverse engineer, interfere with or circumvent the security, rate limits or access controls of the Service;
- use the Service to infringe anyone's rights, harass anyone, or break any law or platform terms;
- claim ownership of content created by someone else.
7. AI features
Some features, such as caption suggestions, use artificial intelligence. AI output can be inaccurate, incomplete or similar to content produced for others. Review anything generated before you use it; you are responsible for how you use it. Do not submit content you do not have the right to share.
8. Our intellectual property
The Service, including its software, design, text, graphics and the DiscoverVirals name and logo, belongs to us or our licensors. While your access is active, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the Service for your own creative or internal business purposes. If you send us feedback or ideas, we may use them without any obligation to you.
9. Suspension and termination
We may suspend or end your access at any time if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service or any information in it is accurate, complete, current or uninterrupted, or that using it will make any content perform well or go viral. Figures shown in the Service may be estimates.
11. Limitation of liability
To the fullest extent permitted by law, DiscoverVirals will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for any claim related to the Service will not exceed the greater of US$100 or the amount you paid us directly for the Service in the 12 months before the claim.
12. Indemnity
You will defend, indemnify and hold harmless DiscoverVirals from any claims, damages, losses and expenses (including reasonable legal fees) arising from your use of the Service, your use of any content obtained through it, or your violation of these Terms or anyone else's rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction, except that either party may bring an eligible claim in small-claims court.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, provide notice through the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.
15. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
